“The Scope of Platform Operator’s Duty in Co-Listing: Investigating and Removing Non-Identical Goods Upon Complaint, ” by Yasuhiro Sato (The Invention 2025 No.11)

Yasuhiro Sato wrote an article published in The Invention 2025 No.11.  Yasu’s article, “The Scope of Platform Operator’s Duty in Co-Listing: Investigating and Removing Non-Identical Goods Upon Complaint” analyzes a recent court decision on platform liability in co-listing systems, where multiple sellers offer goods on the same product page.  The court held that the platform operator is not required to confirm the identity of goods in the co-listing system it adopted.  However, the court crucially held that the operator does have an ex-post duty to investigate and remove non-genuine products once it receives a compliant from a seller using the platform.
